Respected Sir,

It is to inform your kind honour that Directorate vide letter number 02-02/2018-SR dated 8th March 2018 had proposed to hold periodical meetings with this Association under your Chairmanship in the month of March-18 itself. Accordingly Agenda items were also called for, which this association submitted by due date i.e. before 22-3-2018 but sorry to inform you that no meeting has so far been arranged.

Notwithstanding, this association is waiting for the settlement of long pending issues like convening of DPC for promotion to JTS cadre, grant of NFSG to PS Group “B” promoted after 1-1-2012, anomalies arises consequent upon placing IPs and ASPs in the same GP w.e.f. 1-1-2006 etc.

In view of above, this association request you to kindly give convenient date for a meeting at appropriated level to discuss the long pending issues of PS Group ‘B’ and Group ‘A’ officers. The Association will feel obliged to hear the members of the association. A line of reply is requested.

          Kindly refer to this Association letter of even number dated 12/10/2017 (Copy of letter attached as Annex-I) and 27-12-2017 (Copy attached as Annex-II) requesting your kind honour to pass orders to convene early DPC for promotion to JTS Group ‘A’. Sir you will agree that timely convening of DPC is a genuine demand to avoid cascading effect on the career of our members who are otherwise retiring without reaping benefit of timely promotion covered under the rules.

        It is again requested to your kind honour to kindly take immediate action to convene JTS DPC for 2016-2017, 2018 and start process for 2019. It is also requested to put in place the same retrospectively to safeguard the legitimate right of the deserving employees. Hopping for a just and positive action at the earliest.

DRAFT LETTER FOR APPROVAL OF MEMBERS ON TWO DIFFERENT ISSUES

Sub.   Request for grant of Non-functional Grade Pay to PS Group ‘B’ officers on completion of four years of regular service in PS Group B.

Respected Sir,

Your kind attention is invited towards this Associations letter number CHQ/POA/1-22/2017-18 dated 23.08.18 (Copy enclosed as Annex-A) wherein it was requested to issue necessary orders for grant of Non Functional Selection Grade to PS Group ‘B’ officers on completion of four years of regular services as was granted during 6th CPC recommendation and now same has been extended in all cadres. Whereas no such orders have been passed for Group B officers extending the benefit of Non-functional Grade Pay and fixture benefit of higher responsibility on promotion as required under rule FR 22 1(A) 1 to PS Group B officers.  

It is retreated that on the recommendation of 7th CPC, Postal Superintendents (PS Group B officers) of DOP have been given upgraded GP of Rs. 5400/- w.e.f 1.1.2016 without withdrawing benefit of NFGP after four years of service in Group B. Apparently benefit of pay fixation as required under Rule 13 of CCS (Revised Pay Rules) 2016 covered under FR 22 1(a) 1 is required to be bestowed on completion of four years of service at level 10. Unfortunately this benefit of NFSG has not been conferred to PS Group officers on completion of four years of regular service. Merely placement in GP of Rs.5400/- without actual pay fixture is against the fundamental rules in view of Rule 13 of CCS (Revised Pay Rules) 2016. As such, it is clear that PS Group B officer has been given GP of Rs. 5400/-( Level 9) as a replacement to Rs. 4800/- w.e.f 1.1.2016 without withdrawing benefit of NFGP after four years of service in Group B that should be at level 10. 

In this regards attention is also invited towards Ministry of Finance letter No. 26017/219/2016- Ad.II.A dated 10-4-2017 (copy enclosed as Annex-B) wherein it has been clarified to the revenue department that since 7th CPC recommended only normal replacement pay level for Superintendents so NFSG introduced on the basis of 6th CPC recommendation will continue under 7th CPC regime by replacing the pay structure of pay band and Grade Pay with the corresponding Pay Levels/ Cells in Pay Matrix. As such PS Group B officers are also eligible for fixture of pay on completion of four years of service in Group ‘B’ with corresponding pay levels/cells in Pay Matrix. It is pertinent to mention here that NFSG is being allowed in all the cadres as given in the recommendation of 6th CPC. Hence putting PS Group B officers at disadvantageous and detrimental position by not extending the benefit of NFGP is great injustice.

From the foregoing submissions it unambiguously clear that as given in the various GoI notifications PS Group B officers are eligible for grant of non functional up-gradation after four years of regular service in PS Group “B” by replacing the pay structure of Pay Band and grade Pays with corresponding Pay Levels/Cells in Pay Matrix i.e level 10 with all consequential benefits.

Sub:  Request for redefining the financial benefits in term of 2nd ACP and 3rd MACP at appropriate GP to senior IPs/ASPs , consequent upon placing IPs & ASPs in the same GP of  4600/- w.e.f 1-1-2006 and extending benefit of bunching.

Respected Sir,

          Your kind attention is invited to a letter written by Postal officer association (Copy enclosed as Annex-I) to remove the anomaly occurred due to placing IPs and ASPs at the identical level of 4600/- w.e.f 1-1-2006. These orders nullified the promotion of ASPs (Gazetted) and placed ASPs now working as PS Group B officer in a detrimental and disadvantageous position.
Though briefed in earlier letters, it is again detailed that on the recommendation of 6th pay commission, the pay scale of ASPs was upgraded to 7450-225-10500 from 6500-200-10500. At that time pay of the ASPs were fixed with the multiple of 1.86 with addition of GP of 4600 with reference to what ASPs were drawing in the old scale of 6500-200-10500. This was done without extending benefit of bunching. Thus Department of Expenditure OM No.1/1/2008-IC dated 30.08.2008 given under Rule 7(1) (a)(i) & (ii) of CCS (RP) Rules-2008 was completely ignored which otherwise clearly envisages that whose scale has been upgraded from 6500-10500/- to 7450-11500/- in the pre-revised scale and placed in the pay band Rs.9300-34800/- in such cases bunching benefit should be extended in the following manner.

          Furthermore, consequent upon placing ASPs and IPs in the same GP of 4600/- corresponding to the old pay scale of 7450-225-10500 that ASPs never enjoyed even prior to 1-1-2006, the promotion already given to ASPs  in the lower scale of 6500-200-10500 has become redundant and need to be discarded. As clarified in DoPT OM No. 35034/1/97-Estt (D) (Vol. IV) dated 12.02.2000 and 18.7.2001, the ASPs are apparently eligible for 2nd ACP in the scale of 7500-250-12000 (GP of 4800/-) on completion of 24 years service. On introduction of MACP, the ASPs become eligible for 3rd MACP on completion of 30 years of service in the GP of Rs.5400/-.
 It is pertinent to mention here that Postal Directorate while circulating salient features of MACP has also clearly mentioned in para 5 (a) & (b) of the MACP scheme circulated from file number 4-7(MACPS) 2009-PCC dated 18-9-2009 that:
(a)                A Government servant who was recruited in the pre-revised pay scale 5000-8000 and who did not get a promotion even after 25 years of service prior to 1-1-2006 in his case as on 1-1-2006 he would have got two financial up-gradations under ACP to the next grades in the hierarchy of his organisation to the pre-revised scales 5500-9000, 6500-10500.
(b)               Another Government recruited in the same hierarchy in the pre-revised scale of Rs.5000-8000 has also completed 25 years of service but not got two promotions to the next higher grades of Rs.5500-9000 and Rs. 6500-10500 during his period.
Thus in both the cases, since GP of Rs. 4200 will be granted so the promotion/Financial up-gradations given under ACP Scheme to the pre-revised scales of Rs. 5000-8000, 5500-9000 and Rs.6500-10500 so financial up-gradation will be granted both in the case of (a) and (b) above to the next higher grade pay of Rs. 4600/- and Rs.4800/- in the pay band PB2.

          Besides, DG (P) in letter number 4-7/(MACPS)2009-PCC dated 11-1-2013 after taking clearance from DoPT has further clarified that prior to introduction of MACPS, promotion/financial up-gradation in Posts which carry the same GP due to merger of pay scales/up-gradation recommended by the CPC are to be ignored in terms of clarification given on point of doubt 1 of ACP dated 10-2-2000 for the purpose of ACP. Accordingly all promotions/ financial up-gradations in Posts which carry the same grade pay due to merger of Pay scales/ up-gradation under the MACPs provided the posts carry the same grade pay have been merged. In view of this, ASPs should be given GP of Rs.4800/- from 1-1-2006 i.e two promotion upto 1-1-2006 who completed 24 years of service. Thereafter 3rd MACP on completion of 30 years of continuous service from the date of joining in PA cadre in the GP of Rs. 5400/-.

          In view of the clarifications issued by Directorate and DoPT, It is requested that suitable orders may kindly be issued to circles to conduct review DPC for grant of ACP-II in the GP of Rs. 4800/- from 1-1-2006 for those who completed 24 years of service as on 1-1-2006 and 3rd MACP in the GP Rs.5400/- on completion of 30 years of service with all consequential benefits. Also as per Department of Expenditure OM No.1/1/2008-IC dated 30.08.2008 given under Rule 7(1) (a)(i) & (ii) of CCS (RP) Rules-2008 bunching benefit as required under the rules may kindly be ordered to extend.

Request for issue of orders to grant financial benefits on 01/01/2006 to senior IPs, ASPs and Group B officers consequent upon placing IPs & ASPs in the same scale.

Sub:  Request for issue of orders to grant financial benefits on 01/01/2006 to senior IPs, ASPs and Group B officers consequent upon placing IPs & ASPs in the same scale.
                Postal officer Association intend to refer to Postal Directorate letter number 2-12/2013-PCC dated 24-10-2017 and to inform you that consequent upon placing IPs and ASPs in the same GP w.e.f 1-1-2006, the Grade Pay of both the cadre has became identical at the level of 4600/-. This position has placed the ASPs (Gazetted) in a detrimental and disadvantageous level. As such the promotion already awarded at the level of ASPs prior to 1-1-2006 or working as ASPs on that day has now no meaning and thus stood nullified. Due to this disadvantageous position DoPT in a point of doubt no.1 of Annexure of ACP order no.45034/1/97-Estt(D) dtd 09.08.99 had clarified that when the lower pay and the higher pay are equal the ACP (financial up-gradation) given to ASP has to be ignored and fresh ACP should be given.
Furthermore, since ASPs and IPs have been placed in the same GP of 4600/- corresponding to the old pay scale of 7450-225-10500 so provision for grant of MACP or ACP will have to be redefined in view of the clarification issued on ACP scheme vide DoPT OM No. 35034/1/97-Estt (D) (Vol. IV) dated 12.02.2000 and 18.7.2001. As also provided in postal directorate letter no.4-7/(MACPS)/2009/PCC dated 18-9-2009 promotion earned /up-gradation granted under the ACP schemes in the past to those grades which now carry the same GP due to the merger of the scales/ up-gradation of posts recommended by the sixth pay commission shall be ignored for the purpose of up-gradation under Modified ACPs.
Apparently the pay fixture benefit to those ASPs who were promoted prior to 1-1-2006 from IPs or who got financial up-gradations prior to 1-1-2006 needs revision as on 01-01-2006 in the same manner as done in case of MTS when they were granted GP of 1900, 2000 & 2400 for 1, 2 & 3rd financial upgradations.
 Association, therefore urge Secretary Posts to issue orders with regard to extending benefits of Grade pay of 4800 and 5400 as on 01-01-2006 to all senior IPs/ASPs, who were promoted to ASP/PS group B cadre or had been granted 2nd financial up-gradation prior to 01/01/2006.

Request for Grant of one increment as provided in MOF OM No. 10/2/2011.E.III/A dated 7-1-2013 to ASPs in the identical GP of Rs. 4600/- to ASPs w.e.f 1-1-2006 .


Sir as tweeted in the Postal Officers Whatsapp Group below place is a separate letter for our demand of addition of one increment as provided in MOF OM No. 10/2/2011.E.III/A dated 7-1-2013 to ASPs in the identical GP of Rs. 4600/- who were working  ASPs w.e.f 1-1-2006 . Kindly go through this letter and submit your kind views if any change is required. Two more letters will be drafted for Grant of GP of Rs. 5400/- after completion of 30 years of service and other for grant of one increment in GP of Rs. 5400 on completion of four years of service in PS Group B. Sir cooperation of our esteemed members is required.

Respected Sir,

        Postal directorate vide letter number 2-12/2013-PCC dated 24-10-2017 had issued orders revising the GP of Inspector Posts from 4200/- to 4600/- but without resolving the anomalies taken place in the hierarchy. In view of this proviso Postal officer Association had already requested your kind honour to issue orders for grant of one increment to other officers who had worked as ASP as on 1-1-2006, besides revision in ACP/MACP to maintain hierarchical balance. But no specific orders for Group B officer who were at that time working as ASPs or PS Group B officers have been issued along with above orders despite our demand for issuing simultaneous orders in chain of command.

It is reiterated that under 5th pay commission IPs were in the pay scale of 5500-175-9000, the ASPs in 6500-10500 and PS Group B officers in 7500-250-12000. On merger of three scales, IPs were given GP of Rs.4200/-, ASPs 4600/- which was replacement of upgraded scale of 7450-225-11500. Though pay scale of ASPs was upgraded to 7450-225-1150 from 6500-200-10500 facilitating placement of ASPs in GP of 4600/- yet no financial benefit of this up-gradation was conferred to ASPs as on 1-1-2006. Now consequent upon grant of GP of Rs. 4600/- to IPs w.e.f 1-1-2006 with consequential benefit of fixture of pay at the minimum of 17140/- the equation has changed. As such keeping ASPs at the same GP of Rs.4600/- without financial benefit of addition of increment or fixture of pay given under the rules is great injustice and discriminatory to senior officer.

 Moreover as provided in MOF OM No. 10/2/2011.E.III/A dated 7-1-2013(copy enclosed), the fixation of pay on promotion from one post to another where promotional post carries the same GP as the feeder post, in such cases fixture of pay will be done in the manner as prescribed in Rule 13 (i) of CCS (RP) rules 2008.  Apparently the officer who were working as ASPs as on 1-1-2006 are also eligible for fixture of pay w.e.f 1-1-2006 in the identical scale for two different cadres after giving benefit of increment and bunching.
         
Furthermore, since ASPs and IPs have been placed in the same scale so provision for grant of MACP or ACP will have to be redefined in view of the clarification issued on ACP scheme vide DoPT OM No. 35034/1/97-Estt (D) (Vol. IV) dated 12.02.2000 and 18.7.2001. Obviously, the promotion granted to the post of ASP from the lower pay scale of IP is required to be ignored. As also provided in postal directorate letter no.4-7/(MACPS)/2009/PCC dated 18-9-2009 promotion earned /up-gradation granted under the ACP schemes in the past to those grades which now carry the same GP due to the merger of the scales/ up-gradation of posts recommended by the sixth pay commission shall be ignored for the purpose of up-gradation under Modified ACPs.

 In the light of above submissions and the fact that cadre of Inspector Post (Non-Gazetted) and ASP (Gazetted) have been placed in the identical GP of Rs. 4600/-, it is most humbly prayed that pay of the all eligible Group B officers who were working as ASPs as on 1-1-2006 may kindly be ordered to re-fix w.e.f 1-1-2006 by giving addition of one increment and redefined the prevision of MACP/ACP as submitted above keeping in view  the provision of ACP/MACP . This will meet the end of justice.
