Regarding safeguards for Inspecting Officers against alleged subsidiary offence in a fraud case.

Respected Sir,

 

                Most humbly I would like to draw your kind attention towards making the inspecting officers as subsidiary offender in different loss & fraud cases in the recent past. At present, it is the situation that if any loss or fraud case comes to light in any division or sub-division, then the focus of the whole investigation is only and only what may be lapses in the part of the inspecting officer and all the inspecting officers are living only in this atmosphere of fear that when and in which case they will be made a subsidiary offender. It is well known fact that inspection is a tool of improvement for the organization. For better improvement, questionnaire are prepared and supplied to inspecting authority for references/ guidelines.

 

2.                   It is to submitted that after the implementation of CBS and CSI, many frauds have taken place across the country in the last few years and in all those cases the concerned Inspecting Officers have definitely been punished by making them a subsidiary offender. This practice is creating panic amongst all the Inspecting Officers and this need to be looked into in the interest of the department as this situation only gives them stress and de-motivation and it is meaningless to expect a very good result from a team living in stress and de-motivation. We need not to panic our workforce but to strengthen them so that we can get better outputs.

 

3.                   Association wants to highlight that most of the chargesheets are being issued to supervisory officer just on the ground of non compliance of questionnaire in toto. Whereas questionnaire is self variable in every month or two month by issuing amendments/corrigendum. It also mention that inspecting authorities may use their mind during inspection for improvement of the organization. But, it is not being applied due to fear that they may be chargesheeted  for non-compliance of questionnaire. Even officers are hesitating to make inspection due to this phenomenon. It is not correct for the sake of development of department. Better service environment could not be created with this mindset. Therefore, association urges that subsidiary offenders should be identified based on the specific lapses/ non compliance of specific rules/ instructions not on the whims of that ‘ if you have do these things, it may not be happened’.

                                               

4.                   Association wants to welcome whole heartedly that actual problems of the field officer have been realized  about recovery of losses caused due to frauds and accordingly,  Demi Official letter No.Inv-17/18/2021-Inv-Dop dated 29.11.2021 has been issued by your good-self.

 

5.                   Further, regarding making Inspecting Officers as subsidiary offender in a fraud case, I would like to place the  following few points also in your kind honour for objective assessment of facts and circumstances facing by the Inspecting Officers :

 

i.         Divisional heads are not only working as inspecting authority. They have role of HR management of the division, cash management at Post Offices, estate management, Publicity of products at ground level, procuring business, making liaison with intermediary organization at district level, material management at division level, handling grievance of all stock holders, doing protocol duty, etc. They are sole responsible for proper functioning of the division.

ii.       There is inherent requirement of clerical assistance to sub divisional heads to cope up with the increasing burden, but till date no clerical assistance has been provided to them.

iii.      After launching of IPPB, work of inspection and verification of transactions of IPPB at all the access points have been included in the Inspection Questionnaire, but reporting pattern of the IPPB is very poor. It is also well known fact that special audit/inspection system is there in banking system. There is special team for this work. But, here is only solution i.e. divisional/sub divisional heads.

iv.     After issuing revised inspection questionnaire of HO/SO/BO, several amendments have been made therein, but it is also a fact that no tool has been developed till date to carry out the inspection easily and it has been completely imposed on the inspecting authorities to do the inspection in any way.

v.       It is fact that division has been created based on the norms which is created long back based on Maratha Time Test. No further time test has been prepared/defined whereas whole process, works, priorities, etc. have been completely changed in the department.

 

6.                   Therefore, this Association urged in your kind honour that inspection should not be a ground of subsidiary offence and the practice of making inspecting officers as subsidiary offender need to be stopped keeping in view of facts and circumstances narrated above. Inspecting officers may kindly be encouraged by safeguarding them against demoralizing by the punishment/ identifying as subsidiary offender without any proper justification.

Respected Sir,

 

            With due respect, the Association likes to draw your kind attention on the revised guidelines to be followed on allotment / re-allotment of Postal Service Group B officers from one Circle/Unit to other Circle/Unit issued vide Dte. Circular No. 9-23/2014-SPG dated 18.05.2018. Policy on allotment of PS  Gr B officer was in vogue since year back which was reconfirmed vide order dated 23.03.2017 but, surprisingly these policies have been amended suddenly on 18.05.2018 without inviting, suggestions views and comments from stake holders and the Association. Earlier policies was in vogue without any difficulties at employee level as well as employer level. Purpose of such policies should be for the sake of employees and employers. The earlier policy issued on 23.03.2017 was welcomed by the association and its members as it was issued to accommodate the PS Group ‘B’  officers to their home Circle upto the extent possible and if not possible with respect to available vacancy in the particular Circle, they are allotted to nearby Circle. This policy has a positive impact for the members/officers and it was felt that department is thinking for the welfare of their employees and setting up a rotation to create a good environment of working.

 

 2.                  After issue of Dte. Circular No. 9-23/2014-SPG dated 18.05.2018, PS Group ‘B’ officers on promotion from IP/ ASP cadre  were posted outside their home circle vide memo No. 9-01/2018-SPG-II(I) dated 06/09/2018 citing the guidelines for allotment/ reallotment of Postal Service Group ‘B’ officers from one circle issued vide Directorate letter No. 9-23/2014-SPG dated 18/05/2018. As per these policy guidelines, the circle tenure was prescribed as 3 years.

 

2.1        The transfer guidelines were further revised vide Directorate letter of even number dated 25/02/2020. According to these guidelines, officers shall be considered for re-allotment to their Home Circle after completion of one year in the Circle of posting. Accordingly, Directorate has issued orders for re allotment of PS Group ‘B’ officers to home circles.

 

3.              At this juncture, the Association would like to bring to your kind notice that still there are many officers waiting for reallotment to their Home Circle even after having completed more than 3 (three) years of normal Circle Tenure also in month of September/ October-2021. There are clear vacancies existing in many circles for which these officers have request for reallotment. But, still reallotment orders have not been issued which is causing much distress.

 

4.               The association humbly submits that those officers waiting for re-allotment / repatriation are suffering a lot and the newly detected Omicron variant of COVID-19 is also a cause of concern them. Most of them stay alone in their posted locations due to the circumstances beyond their control and they have already suffered a lot during the two lock downs enforced in the country and they are having a fear of their survival now as WHO declared the Omicron variant as “Variant of Concern” which really is causing a lot of fear in these officers and their family members.

 

5.      Due to inordinate delay in the re-allotment / repatriation, those officers are getting distressed and becoming nervous and not able to concentrate on their work smoothly which ultimately reflects the achievement of targets assigned.

 

6.         As per the information available with the Association,  approx. 70 PS Group B officers are awaiting their re-allotment / repatriation. The Association would like to cite few examples. There are 3 (three) clear vacancies in PS Group ‘B’ cadre in Andhra Pradesh Circle as on 01/12/2021 and nearly 7 (seven)  PS Group ‘B’ officers are awaiting reallotment to Andhra Pradesh Circle from outstation circles, most of them completing normal circle tenure of 3 (three years).  Similarly, there are 5 (five) clear vacancies in PS Group ‘B’ cadre in Teangana Circle as on 01/12/2021 and nearly 9 (nine) PS Group ‘B’ officers are awaiting reallotment to Telangana Circle from outstation circles, most of them completing normal circle tenure of 3 (three years). Similar situation is prevailing in almost all the circle where officers are waiting for their repatriation specially at the time of Covid -19 where whole world is encouraging work from home.

 

7.       In view of the above, Association humbly requests to withdraw the re allotment policy of PS Gr-B issued in the year 2018 and restoration of the policy which was issued in  2017. It is also requested to issue orders for reallotment of all PS Gr ‘B’ officers to their home circles as per their requests immediately to the extent of vacancies available in the circle, taking into account of clear vacancies arising upto 01/01/2022.

Periodical meeting with DG(Posts) on 02.12.2021

As scheduled periodical meeting took place on 02.12.2021 in the conference hall of Dak Bhawan with non federal union/association which was held under the Chairman Ship of Shri Alok Sharma, Director General Postal Services, in presence of Shri Marven Alexandar, Member(P), Shri Arvind Verma, DDG(P) who is also holding additional charge of DDG(SR),Shri Pawan Kumar Singh,DDG(FS),Smt. Smriti Sharan,DDG(Estt). 

From Postal Officers Association (I), Rajiv Kumar, General Secretary and Shri Permanand attended the said meeting. DDG(P) welcomed all. There after agenda items were discussed. 

The agenda as follows

             1.Convening of JTS DPC meeting:    From association side it was placed that no DPC has been held for the vacancies after 2016. Hence, many officer are retiring without getting their due JTS promotion. Matter was discussed in details and it was stated by DDG (P) sir that they are preparing for DPC. However, it will depend on outcome of pending court case. 

             2. Extension of Non Functional Grade to PS Group B Offices: From association side it was strongly placed that in VI th pay commission, NFU was granted to PS Gr. B officer due to stagnation in cadre but in VIIth CPC, neither it has been granted nor denied. Still in PS Gr B cadre we are facing stagnation that will continue even after we get timely promotion. It was stated by DDG(Estt) that proposal was already rejected in the year 2019. On request of association administration is ready once again to submit the proposal to MOF.

             Further by the permission of Respected DG(Posts) Sir, Association was permitted to place one more agenda. From association. It was placed that Cadre restructure of PS Gr B has not done since inception. Cadre restructuring of even AAO has been done. They were surprised and suggested to submit detail proposal, which will be submitted soon. 

             After, the periodic meeting, we personally met DG (Posts), Member (P) PSB, DDG(P) & DDG (establishment) and submitted our representations on various other issues such as revival of old Transfer Policy and repatriation / re-allotment of PS Group B officers, as per their request. Hopefully, we may expect the same by next month. 
            
             One representation requesting safeguards safeguard for Inspecting Officers was also submitted and the matter was discussed & submitted before DG Sir also. 

             With regard, to JTS DPC, we should have consensus among our members regarding seniority issue. A CWC meeting is proposed to be held shortly to clear the deadlock.

 Shri R S Gaikwad, APMG, % PMG, Pune Region, Pune has taken last breath in today morning in Nobel Hospital Pune. He was suffering from Jaundice and admitted in the hospital in last week. He was Vice President during 2011-2012 to IP / ASP Association and also elected as Circle Secretary to IP/ASP Association of Maharashtra Circle Branch for the year 2004-2005.

He was most reliable, honest, dedicated and always similing person.

Sad News : Shri N R Shedge, ADPS, % PMG, Pune Region is no more

Sad News : Shri N R Shedge, ADPS, % PMG, Pune Region is no more. He took last breath today evening. He was admitted last week in AIMS Hospital at Aundh Pune due to CORONA positive. Late Shri N R Shedge was 1992 IP batch and due for retirement on 31-5-2023. Last year he was given adhoc promotion in JTS Gr A cadre and posted as SSP, Satara Division under Pune Region but he refused the promotion as it was not convenient to him. He worked in CO Mumbai also as ADPS (BD) and got allotment to Pune Region where he worked as SRM 'BM' Division, Manager BD, Sr PM Pune City HO etc. He was my batch-mate. Late Shri Shedge was very sincere and hard worker in official work.

Sub :- Request for considering all eligible officers for bunching of pay taking the base pay as ₹ 18460/- reg. 

Respected Sir, 


The 37th Biennial Conference of Postal Officer’s Association [India] was held on 20th February 2021 & 21st February 2021 at Hotel Vestin Park, Monteith Road, Egmore, Chennai   600 008. Various issues concerning the Cadre were discussed in detail and the following resolution is passed unanimously. 


“Postal Officer’s Association [India] unanimously resolve in All India Conference at Chennai to request the Director General, Postal Services to issue common order from Directorate regarding the eligibility of Bunching w.e.f 01.01.2006”.


It is submitted that, the pay scale of IPs was upgraded to 7450-225-10500 from 6500-200-10500 i.e. upgraded to GP of Rs. 4600/-. But the pay of IPs was fixed with the multiple factor of 1.86 with addition of GP of Rs. 4600 without extending the benefit of bunching. Thus, the instructions of Department of Expenditure vide OM No. 1/1/2008-IC dated 30.08.2008 given under Rule 7(1) (a)(i) & (ii) of CCS [RP] Rules, 2008 was completely ignored. There were many representations from Associations / Members proposal was taken up by the Department with Department of Expenditure. But the proposal was not agreed by the Department of Expenditure and the same was communicated by the Department vide letter No. 41-03/2020-PAP dated 20.08.2020. 


It is kindly requested to take up proposal again with Department of Expenditure with favorable recommendations from the Department to consider allowing benefit of bunching for all eligible officers in Inspector line officials w.e.f 01.01.2006 considering the base pay as Rs.18,460.

Respected Sir, 


The 37th Biennial Conference of Postal Officer’s Association [India] was held on 20th February 2021 & 21st February 2021 at Hotel Vestin Park, Monteith Road, Egmore, Chennai                  600 008. Various issues concerning the Cadre were discussed in detail and the following resolution is passed unanimously. 


“Postal Officer’s Association [India] unanimously resolve in All India Conference at Chennai to request the Secretary [Posts], to consider for timely promotion of JTS officers of SLY 2016 w.e.f 01.01.2020 to STS cadre”. 


The last JTS list pertaining to the year 2016 was released by Directorate vide Memo No.                    4-18/2015-SPG dated 23.05.2019. Though the officers were selected against the vacancies pertaining to the year 2016 and their seniority is also fixed according to the selection year 2016, they have joined in the JTS posts only in the year 2019, due to administrative delays in convening the DPC. As per Recruitment Rules, officers with 4 years of service in JTS cadre are considered for promotion to STS cadre. Since the seniority of the JTS officers selected under SLY 2016 is also notionally fixed w.e.f 2016, it is kindly requested to consider for timely promotion of JTS officers of SLY 2016 w.e.f. 01.01.2020 to STS cadre, taking the Year of Selection as criteria instead of considering the actual date of joining.


Many officers in JTS cadre selected under SLY 2016 are in the verge of their retirement and timely issue of STS orders considering the year of selection will help many officers to get their due promotion on time before their retirement. 


It is therefore kindly requested to consider the case favorably and cause to issue orders for promotion of JTS officers of SLY 2016 to STS cadre w.e.f 01.01.2020.

Resolution 5: Enhancement of grade pay of ASP@4800 and simultaneously enhance the grade pay of PS Group B officers @5400 w.e.f 01.01.2006.

Sub :- Enhancement of Grade Pay of ASPs @ Rs 4800 and simultaneously enhance the Grade Pay of PS Group B officers @ Rs.5400 w.e.f 01.01.2006- reg. 

Respected Sir, 


The 37th Biennial Conference of Postal Officer’s Association [India] was held on 20th February 2021 & 21st February 2021 at Hotel Vestin Park, Monteith Road, Egmore, Chennai                  600 008. Various issues concerning the Cadre were discussed in detail and the following resolution is passed unanimously. 


“Postal Officer’s Association [India] unanimously resolve in All India Conference at Chennai to request the Director General, Postal Services to consider the case of upgradation of Grade Pay of ASPs @ Rs.4800 and simultaneously upgrade the Grade Pay of PS Group B Officers @ Rs. 5400 w.e.f 01.01.2006”. 


Directorate vide memo no.2-12/2013-PCC dated 24.10.2017 has approved the upgradation of Grade Pay of Inspector Posts cadre from Rs.4200 to Rs.4600 w.e.f 01.01.2006 as per the recommendations of the 6th CPC. However, Grade Pay of ASPs who are holding higher responsibilities than the Inspector Posts cadre are also placed in the same Grade Pay of Rs. 4600 w.e.f 01.01.2006 and the same was continued till 31.12.2015. After 01.01.2016, the ASPs are placed in the GP of Rs. 4800 [pre-revised] and placed in corresponding Level in 7th CPC. The anomaly created due to placing of both Inspector Posts and ASPs in the same Grade Pay of Rs. 4600 from 01.01.2006 till 31.12.2015 needs to be set right early. 


Hence as a one-time measure, the case can be re-considered again by taking up the case with favorable recommendations again with Ministry of Finance for upgradation of GP of ASPs at Rs. 4800 w.e.f 01.01.2006 and simultaneous upgradation of PS Group B Officers from Rs.4800 to Rs.5400 w.e.f 01.01.2006. This will help to resolve the anomaly created and will benefit large number of middle level managers of this Department. 


It is therefore kindly requested to consider the case favorably and cause to issue orders for upgradation of Grade Pay of ASPs at Rs.4800 and simultaneously upgrade the Grade Pay of PS Group B Officers at Rs. 5400 w.e.f 01.01.2006.

The 37th Biennial Conference of Postal Officer’s Association [India] was held on 20th February 2021 & 21st February 2021 at Hotel Vestin Park, Monteith Road, Egmore, Chennai                  600 008. Various issues concerning the Cadre were discussed in detail and the following resolution is passed unanimously. 


“Postal Officer’s Association [India] unanimously resolve in All India Conference at Chennai to request the Director General, Postal Services, to kindly review the Transfer Policy of PS Group B Officers”.

 

The transfer policy pertaining to PS Group B Officers was revised vide Postal Directorate letter no. 9-23/2014-SPG dated 18.05.2018, wherein all newly promoted Officers [except few exceptional cases] were sent out of Circle with a tenure period of 3 years outside the Circle. The said transfer policy was reviewed again by the Department vide Directorate letter no. 9-23/2014-SPG dated 25.02.2020, wherein the condition of compulsory transfer of newly promoted officers outside the circle was removed, but the Circle tenure of 3 years was not modified. It is an accepted fact that, in many cadres [eg AAO] repatriation to home circle is considered after completion of 1 year, with TA/TP, whereas in case of PS Group B Officers the same is still fixed at 3 years.


And the criteria for consideration for repatriation is also fixed as “date of joining”, which affects the chances of repatriation of many officers, who does not have the control over date of their relief. When the promotion order allows time line to join in promotion post and when CCS Joining Time Rules, 1979 allows joining time on transfer / promotion, it may not be proper to fix criteria for repatriation based on the date of joining. Rather it would be appropriate to repatriate officers back to Home Circle based on their merit, subject to their joining within a month from the date of issue of relief orders. 


Hence it is kindly requested to consider the request of this Association to have a re-visit on the transfer policy of PS Group B Officers and to consider for revising the Circle tenure [if posted outside the Circle] as one year instead of 3 years and also to revise the condition for repatriation based on merit instead of on the date of joining.

Resolution-3 : Early convening of JTS DPC and release of JTS list

The 37th Biennial Conference of Postal Officer’s Association [India] was held on 20th February 2021 & 21st February 2021 at Hotel Vestin Park, Monteith Road, Egmore, Chennai  600 008. Various issues concerning the Cadre were discussed in detail and the following resolution is passed unanimously. 


“Postal Officer’s Association [India] unanimously resolve in All India Conference at Chennai to request the Secretary [Posts] to kindly convene the DPC for JTS Group A at the earliest and release the JTS list early”.

 

The last JTS list was released by the Department on 23.05.2019 for the Selection year 2016. Though process of DPC from 2017 was commenced, calling for records of officers under Zone of Consideration, the DPC is yet to be convened and JTS list is yet to be released, resulting in delay in timely promotion of many eligible officers. Many eligible officers due for promotion have expressed their grievance due to delay in convening the DPC for JTS, which seems to be a genuine demand considering the monetary loss involved. Few Officers in Zone of Consideration are likely to retire as PS Group B Officers, if the JTS list is not released early. It is known fact that the DPC is delayed due to various CAT/Court cases. It is kindly requested to consider the possibility of releasing the JTS list from 2017, keeping sufficient vacancies for the applicants of those OAs and subject to final verdict of such CAT/Court cases. 


Furthermore, the vacancies reduced for the year 2016-17 against 75 % quota needs to be added to the vacancies of subsequent years since the DPC for 2016-17 should have been completed only as per Recruitment Rules prevailing during such period. And as per instructions contained in DoPT OM No. 22011/4/2013-Estt(D) dated 06.06.2006, the zone of consideration has still to be wide enough to cater to the needs of the Department / Cadre authorities for giving an extended panel against empaneled officers who have retired or will be retiring in the course of the vacancy year or who have refused promotion and are under debarment. Thus, there is a need for optimizing the size of zone of consideration.



It is therefore kindly requested to consider the case favorably and for convening the DPC for JTS and for release of JTS list early after adding the vacancies of 2016-17 reduced due to reduction of quota from 75 % to 50 % and also to review the size of zone of consideration.

Resolution no 1- Amendments in clause 6 of the Constitution of Association

The 37th Biennial Conference of Postal Officer’s Association [India] was held on 20th February 2021 & 21st February 2021 at Hotel Vestin Park, Monteith Road, Egmore, Chennai  600 008. Various issues concerning the Cadre were discussed in detail and the following resolution is passed unanimously. 

“Postal Officer’s Association [India] unanimously resolve in All India Conference at Chennai to amend the provisions of Clause 6 of Constitution of the Association and to revise the monthly subscription through check off system by deduction from salaries by Drawing & Disbursing Officers [DDOs] at Rs.100 per month against the existing amount of Rs.50 per month.”

Accordingly the following amendments are made in Clause 6 of Constitution of the Association:-

Existing Clause 6:- [Subscription]
Subscription will be Rs. 50 per month. 50 % of the subscription shall be remitted to the Finance Secretary of the Central Head Quarters and 50 % will be retained by the branches for meeting their expenses. The branches can raise donation from its members whenever such occasion arises. 

Revised Clause 6:- [Subscription]
Subscription will be Rs. 100 per month. 50 % of the subscription shall be remitted to the Finance Secretary of the Central Head Quarters and 50 % will be retained by the branches for meeting their expenses. The branches can raise donation from its members whenever such occasion arises. 

It is therefore kindly requested to approve the amendments in Clause 6 of the Constitution of the Association and circulate to all concerned at the earliest, so that subscription at revised rates can be recovered from all the members of this Association by the DDOs concerned.
