Sub:- Conducting JTS DPC Group A for the years from 2017 to 2023 - regarding

 

Respected Sir,

 

            This is regarding conducting DPC to JTS Group A cadre for the period from 2017 to 2023. In this regard, a kind reference is invited to this Association letter no. CHQ/POA/1-15/2020 dated 31.08.2020 on Resolution No 03 & 06 of All India Conference held at Chennai and letter no. CHQ/POA/24/2021-23 dated 23.08.2022, the meeting held at Directorate on 02.12.2021 and a short meeting held in the Chairmanship of respected Sir on 16.09.2022 with the office bearers of this association. In the periodical meetings as well as in the meeting held on 16.09.2022,it was agreed to ensure completion of the JTS DPC upto 2023 by December 2022 considering an extended panel of Group B officers in the place of officers who have already retired as on date of DPC.

 

            This association has time and again brought the case of abnormal delay in issue of Promotion orders to the cadre of JTS Group A. The last promotion list pertaining to the year 2016 was issued on 23.05.2019. DPC for promotion to the cadre of JTS Group A from the year 2017-2018 onwards has not been declared so far for the reasons best known to the administration. Resultantly, the officers in the line of consideration are being discriminated financially and are denied fixation in seniority at a relevant place of the given vacancy years.

            We would like to emphasize that many of our senior members who are working as PS Group B officers since 2010 are still continuing in the same cadre without any promotion, only because of the abnormal delay in finalizing the DPC for JTS Group A Cadre. This has not only resulted in heavy financial loss of recurring nature to these members, but has a cascading effect in their future promotions also, which has created immense frustration, there by affecting the productivity in the field.

            In the meeting held on 16.09.2022, decision of the Govt. of India, communicated vide Directorate letter no. F.No. W-18/2/2022-SPN-1 dated 15.07.2022 was also discussed and it was agreed to take up the JTS DPC case in mission mode. But it is very painful to bring in to your kind notice that no initiative has been taken so far to complete the JTC DPC upto 2023 and neither fresh Zone of Consideration has been issued nor any communication in this respect has been made with Circles till date.

 

            We once again request your honour to issue immediate action for conduction of DPC to JTS Group A from 2017 to 2023 taking the DPC quota vacancy of STS also into consideration and by drawing an extended ZoC of the senior Group B officers in the place of officers who have already retired as on date of DPC. This will not only boost the morale of the senior Group B officers but also enhance the

 

 

 

chance of the senior IP/ASPs to get their promotion in PS Group B cadre, thereby benefiting a large number of senior PS Group B and IP/ASP officers who are the backbone of the department in the field.

 

            Therefore, this association once again urges in your honour to take immediate initiative for completion of JTS DPC up to the year 2023 taking vacancy of STS Quota till availability of regular STS from JTS.

Regarding long pending issues of Postal Officers Association (India) discussed on 16.09.2022 during visit of Dte. by GS.

Sub: - Regarding long pending issues of Postal Officers Association (India).

 

Respected Sir,

 

All India CWC of POA (I) is scheduled to be held on 17/18.09.2022 at New Delhi. Prior to meeting it is necessary for the association to know the latest update on long pending issues. Few issues are listed below:-

 

1. Convening of JTS DPC meeting.

 

DPC for promotion to the cadre of JTS Gr’A’ for the year 2017-18 onwards has not been declared so far the reasons best known to administration. Resultantly, the officers in the line of consideration are being discriminated financially and are construing denial of fixation in seniority at a relevant place of the given vacancy year.

 

Moreover non-convening of timely DPCs in JTS Cadre and non posting of STS officers by issuing necessary orders on vacant post in circles years together is placing burden on PS Group B officers either of adhoc arrangement or working thereto on downgraded posts without substantial benefits that too in contravention to DOP&T instruction. Authorities empowered to make adhoc-promotion to Group B only up-to three months (Directorate letter no. 4-9/88-SPG dated 14.10.1989) are exceeding their powers on their own without obtaining specific approval from DOP&T.

 

It is therefore earnestly request to take action for completing the process of DPC adding the vacancies for the year 2016-17 calculated wrongly against 75% quota. Also kindly put in orders to start the process for convening DPC for the year 2018 and onwards taking into consideration all the vacant post of JTS/STS/JAG.

 

2. Extension of Non functional Selection Grade (NFU) to Superintendent (Posts) Group ’B’officers.

 The Superintendent [Posts] who were granted NFU Scale [Non-Financial Up-gradation] of Rs. 5400/- after completion of 4 year regular service in the Grade Pay of Rs. 4800/- due to stagnation in the PS Group “B” Cadre by the 6th CPC is also eligible for the same benefits i.e. NFU Scale [(Non-Financial Up-gradation] of Rs. 5400/L-10 after completion of 4 year regular service in the Grade Pay of Rs. 5400/L-9 since the stagnation in the PS Group ‘B’ Cade is still 7th CPC also.

 

            It has been reported vide Directorate, New Delhi letter No- 4-3-2018/PCC dated 06.08.2019, that request of Superintendent [Posts] for the grant non-functional up-gradation in PB-3 with GP 5400/L-10 [7th CPC] on completion of 4 years of regular service in PB-2 with GP of Rs. 5400/L-9 [7th CPC] is not considered by the Department of Expenditure vide ID Note No 6-1-2019.E.III (B) dated 19.07.2019.

 

 

3. Extension of the Pay Scale of “Rs. 5400/- PB-3 after 4 years {Group ’B’ Gazetted} corresponding to pre-revised scale of Rs. 8000-13500” after completion of 4 years of approved regular service in the Grade Pay of Rs. 4800/- PB-2 on the substantive Post i.e. Superintendent [Posts] {Group ‘B’Gazetted} at PAR with Section Officers{Group ‘B” Gazetted} of Central Secretariat [CSS] to the Supdt [Posts] of D/o Posts on or after 01.01.2006- regarding.

 

The Superintendent [Posts] {Group ‘B’ Gazetted} of D/o Posts who were earlier granted the Pay Scale of Rs. 4800/-PB-2 & Rs. 5400/- PB-2 after 4 years {Group ’B’} corresponding to pre-revised scale of Rs. 8000-13500”after completion of 4 years of approved regular service in the Grade Pay of Rs. 4800/- PB-2 on the substantive Post i.e. Superintendent [Posts] {Group ‘B’ Gazetted}, BUT, Superintendent [Posts] {Group ‘B’ Gazetted} is eligible for the grant of “Rs. 5400/- PB-3 after 4 years {Group ’B’ Gazetted} corresponding to pre-revised scale of “Rs. 8000-13500”at PAR with Section Officers {Group ‘B” Gazetted} of Central Secretariat [CSS] on or after 01.01.2006 who have already granted the  pay scale of “Rs. 4800/-PB-2 & Rs. 5400/- PB-3 after 4 years {Group ’B’} corresponding to pre-revised scale of Rs. 8000-13500” w.e.f 01.01.2006.

 

4. Revision of pay structure in respect of “ASPOs” and “Superintendent [Posts]” in the 6th CPC & 7the CPC regime w.e.f 01.01.2006 and 01.01.2016- regarding.

 

The Hon’ble Central Administrative Tribunal-Hyderabad Bench has pronounced two vital judgments in respect of Assistant Sudpt. [Posts] and Supdt. [Posts] in the month of Dec-2021 and February-2022 as details below:-

Several ASPOs are also promoted as PS Group B Officer either through DPC or LDCE between 6th CPC as well as 7th CPC regime and presently working as PS Group B Officers. In view of above directions of the Hon’ble CAT, Hyderabad Bench, it is humbly submitted that matter may kindly be examined in the Postal Directorate and the proposal at the earliest may kindly be sent to the Ministry of Finance, Department of Expenditure being the Nodal Ministry.

 

5. Revision of Financial Powers for “Heads of Postal Divisions” – reg.

The Financial Power of officers of the Department of Posts of “Head of Circles “and “Head of the Departments” was recently reviewed and enhanced in order to meet the escalation in cost of various items by IFW Wing of Additional Secretary & Financial Advisor duly approved by the Secretary, Department of Posts vide OM No. 6-1/2021. Fin. Cord dated 30.07.2021 which was revised after 13 years but the Financial Powers of “Head of Postal Division” is still to be reviewed/revised.

1.       The Central Working Committee of the Postal Officer’s Association, CHQ commenced on 17.09.2022 at YWCA conference Hall, Ashoka Road, New Delhi at 10.00 hrs as scheduled.

 

2.       Out of 15 office bearers of the CHQ, 11 attended the CWC.

 

3.       And out of 16 Circles, where POA is functional, 8 circles attended the CWC as detailed below:-

Out of 16 Circles, 9 Circles participated in the CWC. President intimated that required quorum is available for the CWC and formally inaugurated the CWC.

 

4.       Shri. Amit Kumar, CS, POA Delhi welcomed the gathering and the reception committee has welcomed President, General Secretary, Finance Secretary and Shri. Roop Chand all the members to the CWC.

 

5.       Shri. E Durairajan, CHQ President in his Presidential address emphasized for ensuring functioning of Association in all Circles and intimated that, after AIC at Chennai in February 2021 and new body was formed in many Circles. And stated that, due to Covid pandemic, CWC was conducted virtually to settle the issues relating to JTS Group A DPC, but cannot succeed in arriving a common decision.

 

President informed the CWC members that, a team headed by our GS visited Directorate on 16.09.2022 and had a healthy discussion with DG, Member [P] and with other officers of Directorate.

 

6.       President intimated that, financial position of CHQ is very poor and requested all Circles to contribute to CHQ and also requested Circles to remit the quota of Subscription. Finance Secretary also emphasized the importance of remitting CHQ quota in the account No. 010019100269 standing open at Bankipore HPO at Patna.

 

7.       General Secretary thanked Directorate & Delhi Circle and their team for making all arrangements for the successful conduction of this CWC.

 

8.       General Secretary intimated that the CHQ has taken steps to revive the Association at Karnataka, UP, Rajasthan & Haryana and promised to revive the remaining circles early [Punjab, Jharkhand, Chatisgarh, J & K, NE].

 

9.       GS requested the members to observe silence for 2 minutes in remembrance of the following members who lost their life:

10.   GS explained the details of periodical meeting conducted with Secretary Posts, DG Posts, Member [P], DDG [P], DDG [FS] & DDG [Estt]. The following issues were discussed in the meeting:

a.       Convening of JTS DPC early

b.      Extension of non-functional grade to PS Group B Officers.

c.       Cadre restructuring.

 

11.   GS also informed that, he met Secretary Posts at PTC Dharbanga on 29.04.2022 and discussed the following subjects:-

a.       Long pending JTS Promotion

b.      Repatriation / Re-allotment of PS Group B Officer, working outside home circle.

c.       Promotion of Government Servants through LDCE against whom disciplinary cases are pending.

 

12.   GS explained the details of discussions held on 16.09.2022 at Directorate as detailed below :-

 

a.       Cadre restructuring

b.      JTS Group A

 

13.   GS explained the steps taken by the CHQ to have a consensus in having a decision for ensuring DPC for JTS at an early date. He intimated that there was a plan for conducting a CWC at Hyderabad but it could not materialize for one or two reasons and intimated that, a virtual CWC was conducted in Feb 2022 to have a detailed discussion on JTS Group A DPC.

 

14.   GS presented a copy of minutes of the virtual CWC held on 20.01.2022. President requested for confirmation of the Virtual CWC meeting and the august body approved the minutes unanimously.

 

15.   GS explained the details about progress of JTS Group A DPC process as detailed below:-

a.        

b.      President emphasized the need for having extended panel for JTS Group A DPC so that, equal number of officers who retired will also get promotion.

 

16.   President sir requested views of members on preparation of Seniority List. Members expressed their views, Smt. Renuka Bhat, requested the Association to take the interest of LDCE members who joined after an Exam which was conducted belatedly by the Department. Shri. Paramanand explained that, as an individual he has different views and as a Association we have a view for the common interest of the members. It was intimated by GS that, it was requested to Directorate to go ahead with publication of final seniority list either as per DoPT directions or as per Court orders.

 

17.   There were very serious omissions on the maintenance of APARs. Non availability of APARs results in abnormal delay in conducting DPCs and if maintenance of APAR is done through Sparrow then all the issues relating to APAR in respect of PS Group B Officers can be settled. Maintenance of APAR for all PS Group B Officers to be maintained in Sparrow so that, issues relating to APARs can be resolved and timely maintenance of APARs can be ensured. It was decided to take up with Directorate and to pass a resolution for the same.

 

18.   Regarding JTS Group A, detailed discussions were there based on CAT orders and High Court case and issues regarding conduct of JTS Group A for limited years only now and it was emphasized for conducting JTS DPC for all the pending years. It was decided to take up with Directorate to, complete DPC for 7 years vacancy [and not to complete it for 3 years] with extended panel so that, equal number of officers against retirement cases can get promotion early. It is to be specifically emphasized for completion of JTS DPC process as early as possible. 

 

19.   It was presented by Shri. K Siva Shankar, AGS that, Directorate is fixing timelines to Circles for completion of DPC & LDCE every year on time for PS Group B so that, all issues created in Seniority because of delayed conducting of DPC & LDCE is not repeated again.

 

20.   GS requested permission for filing a CAT case for Rs.5400 GP after completion of 4 years in PS Group B cadre from 01.01.2006. All Circles agreed to contribute for the Court cases and Circles to contribute Rs.30,000 for legal expenditures. It was decided to file a case on behalf of the Association at CAT Hyderabad.

 

21.   It was requested to have fresh nominations for next AIC and UP & Bihar Circle has agreed to host the Conference in first week of April 2023.

 

22.   It was agreed by the members that, in next AIC participation from all Circles should be ensured and formation of body at all Circles to be ensured.

 

23.   GS presented a detailed proposal for Cadre restructuring before the CWC. Detailed deliberations were there on the proposal and finally it was decided to allow the GS to submit the proposal to the Department. And 15 days’ time was given to CWC members to submit suggestions and modifications in the proposal and a final proposal will be presented by GS before it is submitted to Directorate.

 

24.   Resolutions: -

a.       Reduction of number of Inspection days from 100 days to 50 days.

b.      APAR maintenance through SPARROW.

c.       DPC & LDCE on time.

d.      Annual Health Checkup for PS Group B officers.

 

25.   Shri. K Siva Shankar, AGS summed up the deliberations had from morning as detailed below:-

a.       Minutes of last virtual CWC was confirmed by the body.

b.      It was decided to address to the Department to conduct JTS DPC for 7 years instead of 3 years.

c.       It was decided to permit GS to submit a detailed proposal for Cadre Restructuring and 15 days’ time was granted to all CWC members to submit suggestions & modifications in the proposal.

d.      It was decided to file a case at CAT Hyderabad and all Circles to donate Rs.30,000 for the legal expenses.

e.      It was decided to urge the Department to release the seniority list as per DoPT norms or as per Court orders.

 

26.   President has thanked Delhi Circle for such a wonderful arrangement for this CWC and also expressed his happiness on the number of participants in the CWC. He has assured to take up the cases discussed in CWC with Directorate and also to take action to revive the remaining circles at early date.

 

27.   GS expressed his sincere thanks to President for his active participation in association activities and he also thanked Delhi Circle and Shri. Amit Kumar, CS Delhi Circle for excellent arrangements for the CWC. He also thanked the entire team of POA Members available in Directorate for making the visit at Directorate a success one and for every effort to settle all the issues pertaining to the cadre.

 

28.   With this the President declared the close of the CWC and again thanked for all active participation.
