Clarification on change of date of next increment (DNI) in terms of Rule-10 of CCS (RP) Rules, 2016

Subject:  Clarification on change of date of next increment (DNI) in terms of Rule-10 of CCS (RP) Rules, 2016

 Respected Madam,

A kind attention is drawn towards Clarification issued vide directorate letter No. 1-8/2023-PCC dated 07.11.2024.  In para 3(ii) of illustration 1, it is mentioned that if opted for pay fixation on date of next increment i.e. 01.01.2023, DNI shall remain the same (1st January) as per Rule-10 of CCS (RP) Rules, 2016. The next date of annual increment shall be admissible on 01.01.2024.

            As per Para 5 of ministry of finance, DoE F. No. 4-21/2017-IC/E.III(A) dated 31.07.2018,  “Accordingly, keeping in view the principle followed during the period before 1.1.2016 immediately prior to coming into force of the CCS(RP) Rules, 2016, which has been modified in the revised pay structure in terms of Rule 10 thereof by way of 2 dates of increment on 1st January and 1st July, it is clarified that in case an employee is promoted or granted financial upgradation including upgradation under the MACP scheme on 1st January or 1st July, where the pay is fixed in the Level applicable to the post on which promotion is made in accordance with the Rule 13 of the CCS(RP) Rules, 2016 , the first increment in the Level applicable to the post on which promotion is made shall accrue on the following 1st July or 1st January, as the case may be, provided a period of 6 months’ qualifying service is strictly fulfilled. The next increment thereafter shall, however, accrue only after completion of one year.”

 

            From the above, it is clear that if opted for pay fixation on date of next increment i.e. 01.01.2023, DNI shall be 01.07.2023.

            In view of the above, It is requested that kindly issue necessary amendment in context to ibid letter.

Subject: Regarding clarification on Regular Promotion in terms of Para 4(iii) of MACP consolidated guideline issued in terms of DoPT letter No. 35034/3/2008-Estt(D) (Vol. II) dated 04.07.2017.

 

            As per DoPT letter No. 35034/3/2008-Estt(D) (Vol. II) dated 04.07.2017, “Benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme………………………………………………However, at the time of actual promotion / grant of Non-Functional Scale, if it happens to be in a post is a grade carrying higher grade pay than what is available under MACPS, no pay fixation would be available and only difference of grade pay would be made available. At the time of such regular promotion/grant of Non-Functional Scale to the higher grade pay than what has been given under MACPS, the employee have the option to draw the difference of Grade Pays from the date of such regular promotion/grant of Non -Functional Scale or the date of accrual of next increment in the pay allowed under MACP".

            Now, the question is what is regular promotion? As per DoPT guideline issued vide letter No. DOPT-1721625311004 dated 22.07.2024, “in making promotions, it should be ensured that suitability of the candidates for promotion is considered in an objective and impartial manner. For this purpose, Departmental Promotion Committee [DPC] (for considering Promotion) should be formed in each Ministry/ Department/ Organisation.  In addition, for considering cases of confirmation Departmental Confirmation Committee [DCC] needs to be constituted.” From these inferences, it is clear that promotion is made though DPC.  LDCE (Limited departmental competitive examination) cannot be treated as regular promotion. Form its terminology itself clear that it is limited not regular.

            DoPT has clarified in its original order of MACP that the financial up-gradation under the MACPS is in the immediate next higher grade pay in the hierarchy of recommended revised pay bands and grade pay as given in CCS (Revised Pay) Rules, 2008. If employee is in level 2 and its next regular promotion in hierarchy is level-4. He will get MACP in Level 3 and on its regular promotion in level -4; he will not get benefit of the fixation separately. But, during the illustration issued by the directorate, several time posts shown after MACP are not the regular promotional posts. For example: -

            From above table, it can be said that MTS to PA, PA to IP or AAO, IP to PSS Gp-B, UDC to SO, etc. is not a regular promotion post.

 

            In view of the above, it is requested to issue necessary guidelines/clarification so that court cases, complaint cases may be reduced. Employee may not be unnecessary harassed. Uniformity in deciding the MACP cases and their fixation may be prevailed at the all level between different circle.

Respected Sir,

               A kind reference is invited towards this association letter no. CHq/8/2023-2025 dated 10.07.2023 regarding change of nomenclature of various Group B officers and providing Stenographer. This association had already submitted detailed justification highlighting that 225 posts of ASP/ASRM were upgraded to PS Group B cadre in March 2023 and many of these posts are presently functioning as Dy. SP, Dy SRM and in charge of PH/NSH/BNPL/BPC/CRC/CPC etc. However, the issue of appropriate nomenclature and basic facilities like stenographer and chamber is still pending, which is causing administrative and functional difficulties in the field units.

               Despite the passage of considerable time, no final order has been issued by the Directorate. The matter is of significant importance for smooth functioning of Divisions and units as well as for clarity in administrative hierarchy.

               The Association therefore strongly request to kindly change the nomenclature  of the present posts as proposed below and suitable instruction may be issued for providing stenographer as well as basic infrastructure to all officers :

Subject: Request for reconsideration of Directorate O.M. No. 17-31/2016-GDS (Pt) dated 26.11.2025 regarding revision of Schedule of Engaging Authority under Rule 31 of GDS (Conduct and Engagement) Rules, 2020.

Respected Madam,

On behalf of the members of this Association, we most respectfully submit this representation regarding Directorate O.M. No. 17-31/2016-GDS (Pt) dated 26.11.2025, issued under Rule 31 of the GDS (Conduct and Engagement) Rules, 2020, revising the Schedule of Engaging Authority, Disciplinary Authority and Appellate Authority (SEDA) for Gramin Dak Sevaks.

The revised order appears to centralize the powers relating to engagement of Gramin Dak Sevaks other than BPM at the Divisional level. While the intention of streamlining administrative processes is appreciated, the Association would like to submit certain practical concerns arising from this change.

1. Increased administrative workload at Divisional level

Divisional Heads are already entrusted with extensive responsibilities relating to establishment administration, financial management, vigilance matters, disciplinary proceedings, monitoring of operational performance, implementation of departmental schemes, inspection of major offices and overall supervision of postal operations in the Division.

Moreover, Divisional Head supervises several Sub-Divisions, dozens of Departmental Post Offices and a large number of Branch Offices. Centralizing the powers of engaging authority for all categories of GDS at the Divisional level will considerably increase the administrative burden of Divisional Heads and may result in delays in handling engagement, leave and disciplinary matters relating to GDS staff.

Handling and updation of huge number of PF of the GDS at Divisional level will be herculean task and difficult to update their leave and disciplinary action related records PFs. 

2. Supervisory and inspection role of Sub-Divisional Heads

Sub-Divisional Heads (Inspectors of Posts / Assistant Superintendents of Posts) are the immediate controlling and inspecting authorities of Branch Offices and Gramin Dak Sevaks. They regularly conduct inspections of Branch Offices, monitor the performance of GDS officials and ensure compliance with departmental rules and procedures.

Since Sub-Divisional Heads maintain close operational supervision and have first-hand knowledge of vacancy positions, local conditions and the working of Branch Offices, they are in a much better position to deal with matters relating to engagement and administration of GDS other than BPM.

3. Administrative capacity available at Sub-Divisional offices

Nowadays, in most of the Sub Divisions, clerical assistants have been provided to Sub-Divisional offices, which has strengthened their administrative capacity. With this support system, Sub-Divisional Heads are effectively managing administrative tasks such as:

  • Maintenance of reservation rosters
  • Processing of leave cases
  • Handling disciplinary proceedings
  • Maintenance of engagement records and service particulars of GDS officials

Therefore, Sub-Divisional offices are administratively well equipped to continue discharging the functions of Engaging Authority for GDS other than BPM.

4. Need for prompt decisions for smooth functioning of Branch Offices

Branch Offices are primarily located in rural and remote areas and depend entirely on GDS staff for providing essential postal services to the public. Engagement and substitution matter often require prompt administrative decisions to ensure continuity of services.

Centralization of engagement powers at the Divisional level may lead to procedural delays which could adversely affect the functioning of Branch Offices and the delivery of postal services in rural areas.

5. Effectiveness of the earlier decentralized system

The earlier arrangement, under which Sub-Divisional Heads functioned as Engaging Authority for GDS other than BPM, had been working efficiently for many years. The system ensured quicker administrative action, better field-level supervision and effective administrative control over Branch Offices.

In view of the above facts and operational considerations, the Association most respectfully requests that the Department may kindly:

  1. Review and reconsider the Directorate O.M. No. 17-31/2016-GDS (Pt) dated 26.11.2025 and
  2. Permit Sub-Divisional Heads to continue as Engaging Authority for Gramin Dak Sevaks other than BPM, in the interest of administrative efficiency, decentralization of powers and smooth functioning of Branch Offices.

The Association is sanguine that the Department will consider the genuine concerns of field units and take an appropriate and favourable decision.

Periodical meeting of the Association on 12.03.2026

 

Dear all,


On 12.03.2026 visited Directorate with Chq President Sri Devendra Sharma for attending periodical meeting which was chaired by Hon'ble Secretary Posts Smt. Bandita Kaul Madam in presence of Respected Director General Posts S/Sri Jitendra Gupta Sir,  P.K.Swain, Member (P), Raj Kumar Sir, DDG(Esst. & P), Smt. Mirnali Shrivastava DDG (IR) and other senior officers.


Agend items were discussed in detail 


1.Convening JTS DPC 2026 by including STS vacant posts. 

Reply : DPC for JTS is under process and expected very soon.

        Power for  any downgradation in STS will lie with DE/DOPT. 


2. Counting of Ad hoc period for JTS promoted officers. 

 Reply : There is no such provision,  Matter was placed strongly giving example of recent orders if OS Group B , HAG and others. However Dte. will explore the possibility. .


3. Modifications  in Inspection Questionnaire for DH and reduction of number of days. 

Reply :Discussed in detail and assurance given that revision of Inspection Questioner on the basis of APT 2.0 is under process our views will also be incorporated. POA (I) has also shared interim suggestions. 



Further, on 13.03.2026 Myself with  Shri Devendra Sharma, President  met with Member(P) and other senior officers and  discussed the following points :

1. JTS DPC and Adhoc JTS promotion.

2. Re patriation of officers posted out side the home Circle.

3. PS Group B DPC for year 2025-2026.

4. Revisiting nomenclature and role as well as stenographer to Deputy SPOS/SRM/IN Charge CPC/NSH/BPC and others

5. Publication of seniority list of JTS/PS Group B considering fixation of seniority on vacancy year of the Exam/DPC.

6. Request for reconsideration of Directorate O.M. No. 17-31/2016-GDS (Pt) dated 26.11.2025 regarding revision of Schedule of Engaging Authority under Rule 31 of GDS (Conduct and Engagement) Rules, 2020.
