AGENDA ITEMS PROPOSED TO BE SUBMITTED TO DIRECTORATE


1.   Convening of early regular DPC for promotion to JTS Group ‘A’ and fixing seniority of officers with all consequential benefit from retrospective effect will be the first agenda point. It will be explained in agenda that in case it gets delayed for one reason or other, the employee should ultimately promoted with benefit of promotion with effect from the date the vacancy becomes available. Principle of natural justice would require grant of the benefit with retrospective effect to mitigate the hardship of our members.  In case still no action is taken at directorate level and no DPC is convened, CHQ will file case on the ground of natural justice. Legally members may get benefit and seniority from the date of eligibility for which effected officer should come forward to be party to file case .
2.   Fixture of pay of Group ‘B’ officers w.e.f. 1-1-2006 while issuing orders for placing IPs in GP of Rs.4600/- and Grand of GP of Rs.5400/- on completion of 4 years in GP of Rs. 4800/- earned under MACP to the officers promoted prior to 1-1-2016 will be second Agenda point for discussion. Furthermore in view of clarification issued by Ministry of Finance vide F No. 26017/219/2016- Ad.II.A dated 10-4-2017 separate orders will be asked to issue with the request to continue with NFGP introduced on the basis of 6th CPC recommendation under 7th CPC regime also with the corresponding Pay Levels/ Cells in Pay Matrix. As such pay of all PS Group B officers promoted after 1-1-2016 should also be eligible for fixture of pay on completion of four years of service in Group B with corresponding pay levels/cells in Pay Matrix. In case no action is taken then association will file case in Chandigarh as all existing officer or promoted after 1-1-2016 are in line.
3.  Calculation of Vacancies and fixing of seniority of officers promoted against respective quota is not in consonance to the recruitment rules framed for PS Group B. Since element of direct recruitment is not involved so the principles laid down in Dr. R.N. Bhatnagar case would tilt the balance more than 50% under one quota at one point of time than another question of litigation will arise as reservation cannot increase more that 50% in any case for one category. DOPT letter number 14017/2/1997 dated 19-1-2017 is giving illustration for Direct: Promote and at no point differentiating amongst departmental quotas. As such protecting of seniority for promote in JTS owing to above will be third point of agenda.
  Since for all these activities funds will be required so all are requested to donate funds to CHQ liberally for the cause of members, conducting conference, visiting directorate, filing cases etc,etc.
